1. Introduction
These General Conditions of Sale (hereinafter General Conditions) govern the sale of products marketed by Jointlab Srl using only remote communication technology (via Internet, telephone, fax). All contracts for the purchase of products concluded through the website www.jointlab.com following the procedures indicated therein (online or by telephone, other), between the Seller and the buyers (hereinafter the Customers), will be governed by these Conditions Generali, which form an integral and substantial part of the same.
2. Methods of concluding the contract
The customer can only purchase products in the electronic catalog at the time of placing the order and viewable on the site as described in the relevant information sheets. Jointlab reserves the right to modify the technical information of the products without notice. It is understood that the product description sheet may not be perfectly representative of its characteristics, since it is generic information material.
The information contained on the website www.frigolab.it simply constitutes an invitation to offer. The purchase proposal (order) is formulated by the customer at the time of sending the form containing the characteristics of the requested goods, the price, the chosen payment method and the delivery terms (order form).
Once the order form has been definitively sent, a summary page of the order is displayed and an e-mail confirming receipt of the order is sent, containing all the information.
All orders are subject to acceptance by the Seller who reserves the right to cancel any order at its sole discretion, for example:
to. in case of material errors connected to the Customer's order or to the information sent by the Customer through www.frigolab.it
b. in cases where the Customer does not satisfy the General Conditions of Sale listed in this document.
For each order placed on www.jointlab.com, an invoice is issued to the holder of the order when the goods are shipped and sent by email to the address indicated in the order. For the issuance of the invoice, the information provided by the Customer at the time of the order is authentic. No change in the invoice will be possible after its issue. The wording 'available' of the displayed product is purely indicative given the possibility of multiple purchases at the same time by multiple users. For this reason www.jointlab.com reserves the right, once the order has been received, to check the availability of the goods and, failing that, to promptly notify the customer and, if necessary, refund it. In case of order of material reported as not available, the customer will not be notified.
c. www.jointlab.com can refuse the order of customers who have already ordered goods previously without paying for them, for example orders for goods on delivery, which are not paid and are rejected several times.
3.Prices and terms of payment
The customer will choose the selling price of the product and the relative payment method, among those published on the website www.jointlab.com at the time of sending the order.
The Customer must immediately notify the Seller of any errors or omissions of any kind in the payment conditions and prices contained in the order summary page and / or in the order confirmation e-mail. The Seller reserves the right to change the prices published on the site at any time. The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products. The seller also reserves the right to change the payment conditions at any time when, in his opinion, the financial conditions of the Customer, the records of previous payments or the nature of his relationship with the Seller, suggest such changes.
4. Payment methods
The Customer undertakes to pay the price of the products ordered by:

d. Cash on delivery (cash only up to € 500.00 including VAT - cash only or cashier's check)

5.Transport and Deliveries
The Products are delivered within 3/5 working days (excluding holidays) from receipt of payment and sent by courier. Transport costs are charged to the customer even in the event of re-sending of the goods for any cause. The delivery terms indicated are not binding; they simply indicate the period of time that is presumed to be normally necessary to deliver the goods from the moment of delivery to the courier in charge. The reasons for any delay (not attributable to Jointlab) may be non-exhaustive:

6. Right of ownership and transfer of the risk of deterioration of the asset
The right of ownership of the Products passes to the Customer after full payment of the products themselves or of their delivery, if this is the last. The risks of breakage and / or deterioration of the Products pass to the Customer upon delivery of the goods to the courier.
7. Withdrawal right
Frigolab.it transposes the European Directive 2011/83 / U, which will go into effect from 14 June 2014. This legislation establishes the right of withdrawal, or the ability for the consumer to return the product purchased and the reimbursement of what you pay for it.
This right is reserved exclusively to natural persons (consumers), so it can not be exercised by legal persons and natural persons acting for purposes relating to their professional activity.
To exercise the right of withdrawal must be sent within 14 days of receipt of goods, a communication of his intention to withdraw from the contract. Shipping charges to our company will be at your cost.

4. Within 14 days if the goods are intact (read below), we will reimburse you by bank transfer or Paypal (if purchased with the latter) exactly € 100.00 + VAT less Paypal or credit card commission.
The right of withdrawal is lost if the returned product is not intact, that:
- missing original packaging
- the absence of elements of the product (accessories, cables, instruction manuals etc)
- product damage.
IMPORTANT!
Starting from 5 March 2020, in case the consumer buyer, who makes a purchase on our site selects the form of payment with the PayPal system or credit card, if later the same buyer requests a refund for any reason of the amount paid, this refund will not include the fees deducted by PayPal or by the credit card (equal to a fixed sum of 0, €35 plus a variable sum equal to 3.4%), but only the net amount of the transaction.
Practical example: payment of € 1,000.00, Paypal or credit card retains € 35.00. Net refunded €965.00.
8. Acceptance and Returns of Defective Products
The products will be deemed accepted by the Customer at the time of their delivery. Without prejudice to the case in which the Customer exercises the right of withdrawal pursuant to art. 7 above, such acceptance is presumed until the Customer communicates to the Seller, as soon as possible and in any case no later than 72 hours from the day of receipt of the Products, that the Products themselves have been delivered flawed and / or defective. provided that they are not defects due to transport and therefore not attributable to the Seller. Following this last communication, the Seller will replace the defective products, only after verifying the actual defect of the product.
The reason for the return must not only be communicated at the time of the request by the Customer, but also be reported or rather attached to the return together with the customer's data. For these purposes the customer must be in possession of the invoice received which he must indicate and show.
The return of products purchased through special offers or promotions or as part of a product package may be subject to specific conditions, as described in the same or otherwise communicated to the Customer. No refunds are allowed for individual products purchased as part of a package.
9. Limitation of Liability
Without prejudice to the hypothesis of willful misconduct or gross negligence of the Seller, it is now agreed that, should the Seller's liability in any capacity towards the Customer be ascertained, including the case of total or partial non-fulfillment of the obligations assumed by the Seller towards the Customer as a result of the execution of an order, the Seller's liability cannot exceed the price of the products purchased by the Customer and for which the dispute has arisen.
10. Customer Obligations
Once the purchase procedure provided for by the website www.jointlab.com has been completed, the Customer undertakes to print and keep these general conditions and the information contained on the website www.jointlab.com dedicated to information on how to purchase. , Pursuant to and for the purposes of articles. 3 and 4 of Legislative Decree no. 185/99.
11. Jurisdiction and applicable law
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated online through the website www.frigolab.it is subject to Italian jurisdiction. These general conditions are governed by Italian law and refer, although not expressly provided therein, to Legislative Decree no. 50/92 to Legislative Decree no. 185/99 and the Consumer Code.
12. Jurisdiction
Any dispute that may arise in relation to the contracts governed by these General Conditions or that is in any case connected to them, will be referred to the Court of Milan.
Pursuant to and for the purposes of articles. 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and to accept the General Conditions of sale listed above.
